The racist note that prompted nurse to sue hospital after they let father tattooed with a Swastika demand that only white nurses care for his baby

A Michigan hospital is under fire after a lawsuit claims it fulfilled a father’s request to have no black nurses look after his baby in the neonatal intensive care unit last fall.
A black nurse sued Hurley Medical Center for discrimination and violation of the state civil rights act after the nurse manager reassigned her because of the man’s request for no black nurses, according to the complaint.
The man also pulled up his sleeve to reveal “some type of tattoo which was believed to be a swastika of some kind,” the complaint from nurse Tonya Battle, 49, read. The name of the father who made the request was not included in the court papers.
“Please, No African American Nurses to care for [redacted] Baby per Dad’s request. Thank you,”  read a note that was attached to the baby’s clipboard.
This followed a staff meeting and a call to the nurse's home to inform her of the decision, according to the complaint.
A hospital lawyer eventually told the staff this was illegal, but the lawsuit alleges that black nurses were intentionally not assigned to the baby for the remainder of its stay in the hospital over the next month.
The hospital CEO spoke at a news conference  after the local chapter of Al Sharpton's National Action Network held a press conference at the hospital to demand answers.
"The father was informed that his request could not be granted, and as a result, all nurses remained available to care for his baby," Hurley CEO Melany Gavulic said. "We appreciate the community's concern and involvement today, as we publicly clarify the facts of this case. The medical center looks forward to a quick and amicable resolution."
The nurse had been employed at Hurley for 25 years. She is seeking damages for her distress, harassment and humiliation.
"She's going to win this lawsuit. The real question is what's it worth," local attorney Tom Pabst told . He is not involved in the lawsuit. "If you grant such a request, you're engaging in unlawful conduct."

  1. These were the father's beliefs and should be respected. If he were black or wore turban his beliefs would be honoured then.

    3. I agree. By law the hospital MUST attempt to follow a parent's request. However, the blacks always claim that this violates there civil rights. Since when does civil rights override the rights of religious beliefs. If the father was Muslim, the hospital would definitely oblige the request, which is probably what happened. And the Swastika is an Indian symbol of Peace.

  8. Really though, this dad is a racist and why would the nurse even want to go into his room? I don't think the hospital is to blame and deserves to be sued for "distress, harassment and humiliation." The hospital was just trying to prevent a bad situation from happening. If the african american nurse had stepped in the room she really would have had to deal with distress and harassment!!

  10. It is sad, but this is a request made by a fading number of people. Why would anybody want to limit the ammount of assistance a loved one to receive? They say there are no athiests in fox holes. I would add that there are few who would rather drown than to take any hand offered. I know that this same request has been made for 'home care givers' only to result with fewer hours being provided (fewer staff to choose from results in fewer staff available). Eventually people take what they can get, and what do you know.... grandma now loves that person of colour.

  13. This is so stupid. We preach tolerance, but then no one has tolerance for the intolerant. The hospital didn't fire anyone on the basis of race. The father made a simple request that wasn't unreasonable. Unless the hospital staff was primarily dark skinned, then I don't see why this request would be hard to accommodate.
