Texas police shut down girls' lemonade stand, demand permit

Police in Texas shut down a lemonade stand run by two little girls. They said it was illegal.

Andria and Zoey Green told ABC affiliate KLTV they were trying to raise about $100 for a Father's Day present. They wanted to take him to Splash Kingdom.

They had been selling lemonade and kettle corn for an hour - and made about $25 - when officers showed up and told them they need a $150 permit to sell their lemonade.

Texas House Bill 970, or the Texas Baker's Bill, does not allow the sale of food that needs time or temperature control to prevent it from spoiling. Since lemonade needs to be refrigerated to prevent bacteria growth, police said they needed an inspection from the health department and a permit to sell it.

"It is a lemonade stand, but they also have a permit that they are required to get," Overton Police Chief Clyde Carter said.

"I think that's ridiculous. I think they're 7 and 8, and they're just trying to make money for their own cause," said Sandi Evans, the girls' mother.

Ridiculous or not, Overton police said it's the law and they'll keep enforcing it.

"We have to follow by the state health guidelines," said Carter. "They have to have a permit if they're going to do the lemonade stands."

The sisters plan to try again this weekend. Instead of selling their lemonade, they'll give it away for free and accept donations.

  3. make the lemonade to order. no bacteria. or sign a contract with the purchaser. this will make the sale a private affair which the government does NOT regulate

I will make sure that I visit the great state of Texas, and stop and spend time in this town now, as I will feel really safe, I also think while I am there, I will call the press, the chief of police and the mayor and insist they consider giving these officers some kind of accommodation for their bravery, We have to nip crime in the bud, as ole barney would say, and what better way then to stop it and show them the problems when they are young, for if we ignore these future criminals at early ages, they will progress into real crime, maybe become a cop, or a politician, or lawyer, now we cannot have this and I hope other communities have read this article and will act the same way. I would think they should have gotten a very heavy fine, many hours of community service, and the parents jailed and maybe even lose their children to the state, where they will be raised properly. Can you imagine now that I am done being sarcastic can you imagine this cop sitting around the dinner table or at a gathering with friends and they ask what he did today, and he is stupid enough to bring this up? I would be ashamed of myself, if I were this cop, the chief for defending him, or anyone that thinks this is right, fair or just. This is one of the great things that young people can do, to lean about life, business and thinking skills, but wait, that is the real problem here, they do not want us or young people to have these skills.

  6. "Just doing our jobs..." Yessir, here are some of Americas REAL unsung heroes. Seven years old, and you have some (probably overweight) overbearing minions with guns strapped to their belts, shutting down your lemonade stand and ruining your dream.

  12. I am surprised the cops did not fear for their lives at the hands of two 8 year old girls and have to shoot them to death. Think about it a lemon contains acid that could hurt their eye. These cops need to be fired for not obeying the playbook and shooting the armed criminals to death.

  13. Put a sign up that says "Consume at your own risk." with a smaller one under it saying (Required by law.), you'll probably increase sales...........
